Terms of Service

PropiyoKE ("we", "us", "our") is a property management software platform operated by PropiyoKE Ltd, a company registered in Kenya. Our platform helps landlords and property managers track properties, manage tenants and leases, collect rent, and handle maintenance requests.

By creating an account or using any part of our service, you ("User") agree to be bound by these Terms of Service. If you do not agree, you must not use the platform.

You may use PropiyoKE only if you:

• Are at least 18 years of age.
• Have the legal authority to enter into binding contracts under Kenyan law.
• Are using the platform in your capacity as a property owner, manager, or authorised agent.
• Are not prohibited from using our services under any applicable law.

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at edgarjerry0@gmail.com if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account, including actions taken by staff members or agents you grant access to. You must provide accurate, current information when registering and keep it up to date.

PropiyoKE offers paid subscription tiers billed in Kenyan Shillings (KES). Prices are displayed on our pricing page and may be updated with 30 days' notice.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. No refunds are issued for partial periods already billed. If payment fails, we may suspend access to your account until payment is resolved.

PropiyoKE integrates with Safaricom's M-Pesa payment infrastructure to enable rent collection and payment tracking. By using this feature you acknowledge:

• M-Pesa transactions are processed by Safaricom Limited and are subject to Safaricom's own terms of service and M-Pesa terms and conditions.
• PropiyoKE acts solely as a data conduit. We record and display transaction data but do not hold, process, or transmit funds on your behalf.
• Payment disputes, reversals, or failed transactions must be resolved directly with Safaricom. PropiyoKE bears no liability for M-Pesa service interruptions, incorrect transaction amounts, or errors originating from Safaricom's systems.
• You are responsible for ensuring your M-Pesa business account details are correctly configured in PropiyoKE.

You retain full ownership of all data you upload to PropiyoKE — including property listings, tenant records, lease agreements, and financial records ("Your Data"). We do not claim any ownership rights over Your Data.

You grant PropiyoKE a limited, non-exclusive licence to store, process, and display Your Data solely for the purpose of delivering the service to you. This licence ends when you delete the data or close your account.

You are solely responsible for ensuring that any personal data you enter about tenants or third parties complies with the Kenya Data Protection Act 2019, including obtaining any necessary consents before recording individuals' information.

You agree not to use PropiyoKE to:

• Create fraudulent or fictitious property listings or tenant records.
• Store or transmit unlawful, defamatory, or harassing content.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Reverse-engineer, decompile, or copy any part of the platform.
• Use automated scripts or bots to scrape or extract data from the platform.
• Resell or sublicense access to the platform without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

We aim to maintain high availability but do not guarantee uninterrupted access. We may carry out scheduled maintenance (with advance notice where possible) or experience unplanned downtime. PropiyoKE is not liable for losses arising from service interruptions.

To the maximum extent permitted by Kenyan law, PropiyoKE and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising from your use of or inability to use the platform.

Our total aggregate liability for any claim arising out of or relating to these Terms shall not exceed the total subscription fees you paid to us in the three months preceding the claim.

You may close your account at any time by contacting us. Upon termination, you may export your data within 30 days. After that period we may delete your data from our systems.

We may terminate or suspend your account immediately if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law.

We may update these Terms from time to time. We will notify you by email or via an in-app notice at least 14 days before material changes take effect. Continued use of PropiyoKE after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Kenya. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
